This is a general Terms of Service for the Stokely.ai website, provided for transparency. If you're an active or prospective client, your signed service agreement with Stokes Productions governs your engagement and controls over anything on this page in the event of a conflict.
1. Agreement to these terms
These Terms of Service ("Terms") govern your use of the Stokely.ai website (the "Site"), operated by Stokes Productions ("Stokes Productions," "we," "us," or "our"). By visiting or using the Site, you agree to these Terms. If you do not agree, please don't use the Site.
2. What Stokely.ai is
Stokely is a managed AI operating system for businesses, built and operated by Stokes Productions. It's a done-for-you service: each client gets their own private server and database, with Stokely trained on how their business runs and purpose-built specialist agents underneath it, each scoped to its own permissions, connected into the client's existing tools.
This Site is informational. It describes the service and lets prospective clients start a conversation with us. Browsing the Site, submitting the contact form, or having an initial conversation does not create a client relationship or any obligation on either side. The first conversation is free, with no strings attached.
If we move forward together, the actual service, including scope, fees, term, and service levels, is governed by a separate written service agreement or order form signed by both parties (the "Client Agreement"). These Terms do not include pricing or service commitments; that detail lives in the Client Agreement.
3. Who can use the Site
The Site and the service it describes are intended for business use. By using the Site or contacting us, you represent that you're doing so on behalf of a business, or in a professional capacity evaluating the service for one, and that you're at least 18 years old.
4. Acceptable use
When using the Site, you agree not to:
- Submit false, misleading, or fraudulent information through the contact form or any other part of the Site;
- Attempt to gain unauthorized access to the Site, its infrastructure, or any related systems;
- Interfere with the Site's normal operation, including through scraping, automated bulk submissions, or denial-of-service activity;
- Use the Site to transmit malicious code or content that violates applicable law.
5. Intellectual property
The Site's content, including its text, design, layout, graphics, and the Stokely name and mark, is owned by Stokes Productions or its licensors and is protected by applicable intellectual property law. You may view and share the Site for your own evaluation of the service. You may not copy, reproduce, or repurpose the Site's content for commercial use without our written permission.
6. Third-party services
The Site relies on third-party providers for hosting and fonts. These providers operate under their own terms and privacy practices, which we don't control. See our Privacy Policy for more on how these providers are used.
7. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Site will be uninterrupted, error-free, or secure at all times. Nothing on the Site is a guarantee of specific results from the Stokely service; actual outcomes depend on your business and are addressed, where applicable, in your Client Agreement.
8. Limitation of liability
To the maximum extent permitted by law, Stokes Productions is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability arising from your use of the Site will not exceed one hundred U.S. dollars ($100). This limitation does not apply to the separate Client Agreement, which has its own liability terms.
9. Indemnification
You agree to hold Stokes Productions harmless from claims arising out of your misuse of the Site or your violation of these Terms.
10. Relationship to your Client Agreement
These Terms cover the Site only. If you're a client of the Stokely service, your Client Agreement governs the service itself, including fees, term, data handling within the service, service levels, and termination. If anything in these Terms conflicts with your Client Agreement, the Client Agreement controls.
11. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the Site after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles, and any disputes arising from the Site will be handled in the courts located in Oklahoma.
